We, The Pilates Architects (“TPA” or “we”), have made each piece of equipment with care and skill, and we have thoughtfully sourced our materials and other components. We are proud of the quality equipment we produce and we’re excited to share it with you. Thank you for choosing The Pilates Architects.
We warrant to you, as the original purchaser (“you”), that our equipment listed below will be free from defects in workmanship and materials for the duration of the warranty period for such equipment, subject to the terms below. This warranty becomes effective upon the date TPA delivers the equipment to you.
We retain the right, at our sole option, to repair, replace, or refund for credit the price of any defective equipment (including equipment components and parts) under this warranty. This warranty does not cover shipping or labour charges associated with replacing or repairing warrantied components. Components repaired or replaced under the terms of this warranty will be warrantied for the remainder of the original warranty period only.
Limited 10-year warranty. Our Reformer, Cadillac, and Reformer/Tower Convertible carry a ten-year warranty on the wood frame and metal structural components.
Limited 5-year warranty. Our Arc Chair, Arc Chair Lite, and Arc Ladder Barrel carry a 5-year warranty on the wood frame and metal structural components.
Limited one-year warranty. All springs, spring clips, and other mechanical components are warrantied for one year.
Limited 90-day warranty. All upholstered parts, ropes, straps, and loops are warrantied for 90 days.
Limitations and exclusions under these warranties. To notify us of damages that occurred during shipping, you, the original purchaser, must do so within 48 hours of receipt of equipment.
The limited warranties set out above do not apply to normal wear and tear, cosmetic damage, imperfections that are within design specifications, imperfections that do not materially alter functionality, or damage due to acts of God, accident, abuse, misuse, negligence, lack of normal maintenance, failure to follow instructions, modification, alteration, abnormal service or handling that differs from that specified by us for the equipment, improper installation, or improper operation. Alteration, modification, or repair of part(s) and equipment by anyone other than a TPA technician or authorized service provider will void the warranty.
Custom Orders are not eligible for returns or refunds.
Making a claim. To make a claim under this warranty, you, the original purchaser, may contact us at: warranty@thepilatesarchitects.ca
We may request proof of purchase in order to verify warranty coverage. You must ship prepaid any equipment or components being returned to us for warranty repair, replacement, or credit, accompanied by a packing list and your name. We will not issue credit for equipment or components returned without our express written prior authorization.
We reserve the right to review the defective equipment or components. You will bear all costs of shipping defective equipment or components to and from TPA for inspection. If we determine, in our sole discretion, that it is impractical to ship defective equipment or components back to us, we may designate, in our sole discretion, a repair facility to inspect and estimate the cost to repair such defective equipment or components, and you will bear the cost, if any, of that estimate as well as the cost of shipping the defective equipment or components to and from the repair facility. You must ensure the defective equipment or components remain available for inspection until the warranty claim is finalized. We reserve the right to be subrogated under any existing insurance policies you may have.
Disclaimer of warranties and limitation of liability. This warranty is in lieu of all other warranties, expressed or implied, including without limitation the implied warranties of merchantability and fitness for a particular purpose. No written or verbal advice or information that we give you will create a warranty, whether expressed or implied, nor will it in any way alter the scope of this exclusion of warranties. Repair, replacement, or refund for credit, as provided above, are the only remedies available to you. Correction of defects, in the manner and for the period of time described above, will constitute complete fulfillment of our liabilities and responsibilities to you with respect to contract, negligence, any incidental or consequential damages based upon breach of any express or implied warranty on this equipment or otherwise. We assume no responsibility whatsoever with respect to your use or disposition of our equipment. By accepting delivery of the equipment, you acknowledge and agree that we have made no representations or warranties, express or implied, to or for your benefit which contradict any of the foregoing.
